Functions of Enforcement Committee

The Enforcement Committee— (a) must consider all matters referred to it by the Regulator in terms of section 92 or the Promotion of Access to Information Act and make a finding in respect thereof; and (b) may make any recommendation to the Regulator necessary or incidental to any action that should be taken against— (i) a responsible party in terms of this Act; or (ii) an information officer or head of a private body, as the case may be, in terms of the Promotion of Access to Information Act.

What this means for your estate

  • The Enforcement Committee's job is to consider referred matters and make findings and recommendations to the Regulator (paragraph (a)) — it doesn't itself impose the final enforcement notice; that remains the Regulator's decision under s.95, informed by the Committee's recommendation.
